Governance the migration in  european context

Giovanna Palermo presents a paper about migration processes in Europe. The study of immigration policies has always favoured the national level, formally responsible both for laying down the conditions of entry and stay in a country and for the policies of integration and access to citizenship. The migratory policies of the single member state represent lines of conduct through which a country manages the migratory flows and regularizes the life of immigrants on its soil, whilst adhering to the guidelines and rules laid down by the European Community and by international laws on the protection of immigrants’ rights. The author analyzes the different models adopted, focusing on migration policy in Frankfurt.

Le politiche migratorie del singolo Stato membro rappresentano linee di condotta attraverso le quali un paese gestisce i flussi migratori e regola la vita degli immigrati sul suo territorio, rispettando gli orientamenti e le norme stabilite dalla Comunità europea e dalle leggi internazionali in materia di protezione dei diritti degli immigrati. L’autrice analizza i diversi modelli adottati, focalizzando poi l’attenzione sulla politica migratoria a Francoforte.

Mediazione, dalla rottura al legame

Anne Catherine Salberg presenta un articolo in cui affronta il rapporto tra mediazione e sistema giudiziario. Nella prima parte si considera la mediazione quale mezzo di risoluzione dei conflitti. Si approfondisce il contesto in cui si inserisce la crescita della mediazione, prendendo in considerazione tre diverse prospettive teoriche: i cambiamenti che attraversano la nostra società in relazione alla legge, i cambiamenti dei modelli nella giustizia penale e i cambiamenti rispetto al senso di giustizia. Nella seconda parte del contributo si discute, invece, in modo più concreto dell’istituzionalizzazione della mediazione come modalità cooperativa di gestione dei conflitti, illustrando attraverso l’esempio della recente esperienza di Ginevra per quanto concerne la mediazione in materia penale. La mediazione, conclude la Salberg, offre un approccio diverso in cui, da posizioni opposte, si cerca l’adozione di una soluzione attraverso l’interazione delle persone in conflitto. La logica della mediazione afferma, così, un principio secondo il quale tutti perdono e tutti vincono attraverso.

Anne Catherine Salberg presents an article dealing with the relationship between mediation and the judicial system. In the first part, mediation is considered as a means of resolving conflicts. She deepens the context in which the growth of mediation fits in, taking into account three different theoretical perspectives: the changes that transpire our society in relation to the law, the changes in models in criminal justice, and the changes in the sense of justice. In the second part of the paper, more specifically, the institutionalization of mediation is discussed as a cooperative mode of conflict management, illustrating through the example of the recent Geneva experience as regards mediation in criminal matters. The mediation concludes Salberg, offers a different approach in which, from opposite positions, trying to adopt a solution through the interaction of people in conflict. The logic of mediation thus affirms a principle that everyone loses and everyone wins through.

Il paper analizza il «caso della Francia», in cui è stata condotta un’analisi sul rapporto tra legislazione nazionale, legislazione region-nale e interventi localmente distribuiti. Le politiche di integrazione sono state ricostruite attraverso un’analisi della legislazione che, a vari livelli, dsciplina sia le politiche di migrazione che quelle relative agli immigrati, con particolare attenzione al ruolo svolto dagli enti locali e dai più importanti soggetti coinvolti nel processo di governo.

The work examines in depth the management of the migration phenomenon at local level, by reviewing the inclusion policies. The paper analyzed the «france case», where an analysis was conducted on the link between national legislation, regional legislation and interventions locally deployed. The integration policies have been reconstructed through an analysis of the legislation that, at various levels, governs both the migration policies and those pertaining to immigrants, with a special focus on the role played by local bodies and by the most important stakeholders involved in the network governance process.
